Mediation

Mediation resolves most family law matters faster, more privately, and for a fraction of the cost of a contested trial.

What mediation is

A neutral third party helps both sides negotiate a settlement. The mediator does not decide anything. Nothing is binding until an agreement is signed, and discussions are generally confidential.

Why courts favor it

Many Georgia counties require mediation before a final hearing in contested family matters. Even where it is not required, a mediated agreement that both households helped build tends to be followed more reliably than an imposed order.

When it works

Mediation works when both parties have the information they need and are willing to move. It works poorly when one side is hiding assets, or where there is a history of coercion between the parties.

Preparing properly

The clients who do well in mediation arrive with complete financial disclosure, a clear sense of their priorities, and a bottom line they have thought through in advance.

Common questions

Is mediation binding?

Not until the parties sign a written agreement. Once signed and adopted by the court, it is enforceable.

Can I bring my attorney?

Yes, and we recommend it. Having counsel present means you are advised in real time rather than agreeing to something you do not fully understand.

What if it fails?

The case proceeds toward hearing. Time spent in mediation is rarely wasted, because it narrows the disputed issues.
